Abstract : In the 20 years and more after Shanghai opened its port, it had been gradually changed from a unitary society into a mixed one. This was chiefly expressed in three aspects, i. e. , the interseetion of the limits in Chinese and western management rights, the intersection of Chinese and western interests, and the mixture of laws. The author expounds that the formation of a mixed society after Shanghai opened its port is a result of the interaction of multi-factors, as well as negotiation and consultation. 上海在开埠以后的20多年中,逐渐由一个比较单一的社会,变成混杂型社会,主要表现在中西管理权限交叉、中西利益交叉、中西法律混合三个方面。本文通过上海对西人开放、租界对华人开放、华洋的抗争与合作、混合法庭会审公廨的形成诸问题的论述,说明上海开埠以后混杂型社会的形成,是多种因素交互作用、因缘际会的结果,也是谈判、协商的结果。
